Section 32
Exemption in Maximum Extent of Land
(1) If the land required by an industry exceeds the maximum limit of the land that can be kept according to the prevailing law, such industry may apply to the industry registration body to get an exemption to keep the land up to that amount.
(2) Based on the application received according to sub-section (1), the agency that registers the above shall submit a report with opinion to the Ministry after making necessary investigations.
(3) Based on the application received as per sub-section (1), the Government of Nepal may grant concessions to retain land in excess of the limit, subject to the requirements of the industry and the criteria specified in the approved scheme or project proposal of the industry. The land exempted in excess of the limit cannot be used for any purpose other than the purpose for which the exemption was granted.
(4) In relation to whether the industry is not using the land exempted from restrictions according to the prevailing law, the industry registration body may monitor or impose necessary instructions as specified.
(5) If it is found that the instructions given by the industry registration body as per sub-section (4) are not followed, the Nepalese government may take back the land exceeding the limits of the permission granted by such industry in accordance with the prevailing law.
(6) According to the existing law, the person who has permission to hold land in excess of the limit shall not be allowed to sell and distribute the land held in excess of the limit, or to transfer the rights in any way, or to mortgage the land in banks and financial institutions.
(7) Based on the needs, capital and nature of the industry, the maximum amount of land that the industry can hold, the provisions related to providing land in excess of the limit and the conditions to be followed by the industry in this regard shall be subject to the prevailing laws related to land.
